Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") governs the use of all services ("Services") provided by Midwest Internet Exchange LLC, doing business as FD-IX.com ("FD-IX"), and forms part of the binding agreement between FD-IX and each Customer.

Permitted Use

Customers may use the Services only for lawful purposes and in a manner consistent with the intended use of the FD-IX network.

Prohibited Activities

Prohibited activities include, without limitation:

  • Using the Services for fraudulent purposes or in connection with any criminal offense;
  • Transmitting, receiving, or storing any material that is obscene, defamatory, abusive, infringing, or otherwise unlawful;
  • Sending unsolicited bulk messages ("spam") or knowingly receiving responses to spam sent by others;
  • Engaging in network abuse such as denial-of-service attacks, network flooding, or attempts to crash a host;
  • Transmitting viruses, malware, or malicious code;
  • Attempting to gain unauthorized access to systems, networks, or data;
  • Violating the security or integrity of any network, including the FD-IX network or partner networks.

Customer Responsibility

Customers are responsible for ensuring that their users, clients, and downstream customers comply with this AUP. Violations by such parties will be deemed violations by the Customer.

Enforcement

FD-IX may investigate suspected violations, cooperate with law enforcement, and take any action it deems appropriate, including suspension or termination of Services, without liability.

Modifications

This AUP may be modified at any time by posting an updated version on the FD-IX website. Continued use of the Services constitutes acceptance of the revised AUP.
